BOARD OF
COUNCIL OF THE
CITY OF FORT THOMAS,
CAMPBELL COUNTY, KENTUCKY,
ON
WEDNESDAY, AUGUST 11, 2010

H. Brown called the special meeting of council to order at 7:20 p.m. on Wednesday,
August 11, 2010. The Clerk
called the roll and the following Councilmembers were present: Lisa Kelly, Jim
Doepker, Jill Steller, Eric Haas, and Tom
Lampe. Staff members in attendance included: City Administrator
Don Martin, City
Clerk Melissa Kelly and City Attorney Jann
Seidenfaden.
Report of Boards, Committees, and Commissions
Report from the Law, Labor, License Committee of Council: Jill Steller
reported that the Law, Labor, and License Committee of Council had met prior to
the council meeting to discuss the outdoor dining ordinance.
After lengthy
discussion it was decided to extend the outdoor dining times to 11:00 p.m. Sunday through Thursday and to midnight Friday and Saturday. A permit will be required including a site
plan of where the tables and chairs will be placed, a release and
indemnification form executed by the applicant releasing and indemnifying the
City of Fort Thomas from personal injury liability, a certificate of insurance
with coverage limits acceptable to the City and naming the City as an
additional insured party for injuries or damages occurring on the Public
Sidewalk. The cost of the permit for
each table will be $10 subject to automatic renewal on an annual basis at no
additional charge. The committee also
changed the dates of operation for outdoor dining to March 1 until November
30. Chairs shall be removed from dining
area when not in use. It was also noted
that the front door of the establishment may be propped open but not to allow
unreasonable levels of noise to emanate from the building. Outside speakers, food preparation, cooking
and portable heaters shall not be permitted within the Outdoor Dining
Area. The outdoor dining area shall be
maintained in clean and orderly conditions at all times. The Committee decided to re-visit the
provisions of the ordinance in the fall.
New Business
West Southgate Speed Issue: No additional appeals have been received by
the city to date. The deadline for
appeals is August 16, 2010. If no additional appeals are received, the
city will move forward with the installation of the speed humps.
