ORDINANCE NO. O-12-2010

AN ORDINANCE REPEALING SECTION 97.32 OF THE “CITY OF FORT THOMAS CODE OF ORDINANCES” RELATING TO THE DUTY OF PROPERTY OWNERS TO MAINTAIN AND REPAIR PUBLIC SIDEWALKS.

WHEREAS, City of Fort Thomas Ordinance 1007, adopted on March 4, 1957, and codified as Section 97.32 of the City of Fort Thomas Code of Ordinances, assigned maintenance of public sidewalks to the adjoining property owner; and

WHEREAS, City of Fort Thomas Ordinance O-29-88, adopted on December 19, 1988, and codified as section 97.33 of the City of Fort Thomas Code of Ordinances, assigns maintenance responsibility of all public sidewalks to the City of Fort Thomas in accordance with the city’s sidewalk improvement program; and

WHEREAS, City of Fort Thomas Ordinance O-29-88 supersedes and replaces Ordinance 1007; and

WHEREAS, Section 97.32 of the City of Fort Thomas Code of Ordinances should be repealed to remove conflicting language and correctly reflect that the City of Fort Thomas is responsible for the maintenance of public sidewalks.

NOW, THEREFORE, BE IT ORDAINED THAT:

SECTION I

City of Fort Thomas Ordinance #1007, adopted on March 4, 1957 and codified as Section 97.32 of the “City of Fort Thomas Code of Ordinances” relating to the duty of property owners to maintain and repair public sidewalks which front and abut their private property is hereby repealed in its entirety.

SECTION II

This Ordinance shall be in full force and effect from and after its passage, approval, and publication as required by law.
