ORDINANCE NO. O-17-2010
AN ORDINANCE ACCEPTING THE RECOMMENDATION OF THE FORT THOMAS PLANNING COMMISSION SUBMITTED IN ITS RESOLUTION NO. Z-02-10 AND AMENDING THE OFFICIAL ZONING ORDINANCE OF THE CITY OF FORT THOMAS, CAMPBELL COUNTY, KENTUCKY, BEING ORDINANCE NO. O-16-2007, BY CHANGING THE TEXT OF SECTION 15.1 “GENERAL PROVISIONS” PERTAINING TO THE SIZE, HEIGHT, AREA, SET-BACK, ILLUMINATION AND CONSTRUCTION MATERIAL OF SIGNS PROPOSED TO BE LOCATED WITHIN 100 FEET OF A RESIDENTIAL ZONING DISTRICT.
WHEREAS, on August 2, 2010, the
Board of Council formally requested that the Fort Thomas Planning Commission
review the text of the Zoning Ordinance to allow for a “greater transition from
Commercial zoning district to residential zoning district pertaining to signage”;
and
WHEREAS, the Fort Thomas Planning
Commission conducted a hearing on
WHEREAS,
the Fort Thomas
Planning Commission has submitted Resolution No. Z-02-10 recommending the text
of the Zoning Ordinance be amended as indicated
therein.
NOW, THEREFORE, BE
IT ORDAINED BY THE CITY OF
SECTION I
That Section 15.1
of the Fort Thomas Zoning Ordinance be and the same is
hereby amended as follows:
I. OTHER LIMITATIONS:
1. No sign shall be erected maintained or continued in any zone which is:
a. Constituting a nuisance, because of light, glare, focus, noise, animation, flashing, intensity of illumination as to unduly disturb the use of surrounding properties.
b. Misleading, nor advertising a defunct business establishment or occupant, fraudulent, obscene, immoral, indecent or unsightly in character.
c. Located upon the inside curve of a street which causes any interference to sight distance.
d. A courtesy bench.
2. Any sign
proposed in a location that is within 100 feet of a residential zoning district
shall be subject to review by the Design Review Board. The Design Review Board may restrict the
maximum permitted size, height, and area of a sign by not more than 50%; may
increase the minimum required set-back of a sign by not more than 100%; may
restrict the hours of illumination of a sign; and may restrict the material(s)
used in construction or fabrication of a sign.
The intent of this section is to allow for a
greater transition from a commercial zoning district to a residential zoning
district.
SECTION II
That the City Clerk be and
is hereby authorized and directed to deliver a certified copy of this ordinance
to the Zoning Administrator.
SECTION III
That this
Ordinance shall amend, but not repeal, the existing Official Zoning Ordinance
of the City of
SECTION IV
That this Ordinance shall be
effective when read, passed and advertised at the earliest date according to
law.
