AN ORDINANCE AMENDING SECTION 130.02 OF THE
“
WHEREAS, as currently written, Section 130.02 of the Fort Thomas Code of Ordinances disallows the possession of air rifles, air gun, catapults, sling shots and their projectiles; and
WHEREAS, the intention of City Council to delete those provisions of the ordinance pertaining to the possession and use of air rifles, air guns, catapults, sling shots and their projectiles; and
WHEREAS, it is the intention of City
Council to prohibit the discharge of air rifles, air guns, catapults, sling
shots and their projectiles and provide an exemption for law enforcement
officers.
NOW, THEREFORE BE IT
ORDAINED BY THE CITY OF
That Section 130.02 of the Fort Thomas Code of Ordinances is hereby amended as follows:
§ 130.02 POSSESSION OR USE OF AIR RIFLES OR AIR GUNS.
(A) It shall be unlawful for any person to have
in his possession or to use discharge any air rifle, air gun of any
description or by whatever name know, catapult, a sling shot, or their dangerous
projectile projectiles within the limits of the city. The prohibition of discharge in this section shall
not apply to any police officer acting in his or her official capacity.
(B) The Chief of Police is hereby authorized
and directed to confiscate and destroy any air rifles, air guns or any
description or by whatever name known, catapults, sling shots, or their dangerous
projectiles found in the possession of or used discharged by any
person within the limits of the city.
SECTION II
All
ordinances, resolutions or parts thereof, in conflict with the provisions of
this ordinance, are to the extent of such conflict, hereby repealed.
SECTION III
This
Ordinance shall be in effect when read, passed & published according to
law.
